    Terms of Service

    Last updated: 10 May 2026. These terms govern your use of the YatruX platform.

    Plain-language summary: Pay Rs. 1,000 refundable base deposit (more held per booking for higher-class vehicles). Subscribe monthly. Take photos before & after every ride. Don't crash, don't drink and ride, don't use for delivery. We take 15% commission from owners. Disputes go through our team. Nepal law applies.

    1. Acceptance of terms

    By creating an account, listing a vehicle, or booking a ride on YatruX ('the platform', 'we', 'us'), you agree to these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users — riders, vehicle owners, and visitors.

    2. Eligibility

    You must be at least 18 years old, hold a valid Nepali driving license (or international driving permit accepted in Nepal), be a Nepali citizen or hold a valid visa, and complete KYC verification (citizenship, license, selfie) before subscribing, booking, or listing.

    3. Account & security

    You are responsible for keeping your password and account credentials safe. All activity under your account is treated as yours. Account sharing is prohibited and grounds for permanent termination. Notify us immediately at support@yatrux.com if you suspect unauthorized access.

    4. Refundable security deposit

    Riders must pay a refundable base security deposit of Rs. 1,000 before subscribing. Higher-class vehicles may require an additional booking-time hold (set per vehicle by the renter). After 5 on-time completed trips, additional class holds may be reduced or waived. The deposit is held in YatruX's operating account (no escrow at v1) against potential damages, late returns, or breach of these terms. Upon account closure in good standing, the deposit is refunded within 7 days.

    5. Subscription plans (Riders)

    YatruX offers monthly subscription plans: Basic (scooters only) and Standard (scooters + 150cc bikes). Each plan caps active-days per month and km usage. Subscriptions auto-renew monthly until cancelled. Cancellation takes effect at the end of the current billing cycle. No mid-cycle refunds — if you cancel mid-month, your access continues until the cycle ends.

    6. Bookings, pickup, and return

    Bookings must be requested through the app and confirmed by the vehicle owner. Pickup and return are scheduled at the partner shop or owner's stated location. Riders must arrive on time; failure to pick up within 2 hours of the scheduled time may result in cancellation. Late return beyond agreed end time incurs charges deducted from the deposit.

    7. Mandatory photo handover

    Pre-ride and post-ride condition photos are mandatory. Riders cannot start a trip until pre-ride photos are uploaded; bookings cannot be marked complete until post-ride photos are uploaded. These photos serve as the canonical record for any damage dispute. Refusing to upload photos voids damage waiver protection.

    8. Damage policy & waiver

    Every active subscription includes a damage waiver covering minor incidents up to Rs. 3,000 per occurrence. For major damage, riders pay a Rs. 5,000 deductible; the platform covers any remaining repair cost up to coverage limits, subject to verification via handover photos. Damage caused by negligence, illegal use, racing, or operating under influence is fully the rider's responsibility — waiver does not apply.

    9. Theft & loss

    If a vehicle is stolen during a rider's booking, the rider is liable for 30% of the vehicle's market value (deposit applied first; balance billed). Riders must report theft to police and YatruX within 4 hours, providing the FIR. Failure to report voids any insurance claim and shifts full replacement cost to the rider.

    10. Damage strikes & account suspension

    Damage incidents are tracked per account. Two minor incidents result in a written warning. A third incident within 12 months results in subscription pause and review. Repeated or severe violations result in permanent ban and forfeiture of deposit.

    11. Owner obligations

    Vehicle owners must (a) hold valid registration (blue book) and active third-party insurance for every listed vehicle; (b) ensure every listed vehicle is roadworthy, serviced, and free of major mechanical issues; (c) provide a working helmet at handover; (d) honor confirmed bookings — owner cancellation within 12 hours of pickup may incur a Rs. 1,000 penalty deducted from future payouts.

    12. Platform commission

    YatruX charges a flat 15% platform commission on each completed booking, deducted automatically from the owner's payout. There is no fee to list a vehicle. Payouts are released within 24 hours of the booking being marked complete (with valid post-ride photos).

    13. Prohibited use

    You may not (a) use the vehicle for commercial delivery (Pathao, Foodmandu, etc.), racing, stunts, or off-road riding beyond the vehicle's capability; (b) sub-let or transfer the vehicle to any third party; (c) transport illegal goods; (d) operate under the influence of alcohol or drugs; (e) cross international borders. Violations void all coverage and may result in permanent ban + legal action.

    14. Helmet & safety equipment

    Wearing a certified helmet is mandatory under Nepal law and these terms. Riders must bring their own helmet or use the helmet provided by the owner. YatruX is not liable for injury sustained while riding without a helmet.

    15. Disputes & resolution

    In case of dispute (damage, refund, conduct), either party may submit a complaint to support@yatrux.com. YatruX will mediate within 7 business days using booking records, handover photos, GPS data (when available), and witness statements. YatruX's decision in dispute resolution is final.

    16. Limitation of liability

    YatruX is a peer-to-peer marketplace — we do not own the listed vehicles, employ the owners, or directly insure rides beyond the stated waiver. Our maximum liability for any single transaction is limited to the total platform commission earned on that transaction. We are not liable for indirect, consequential, or punitive damages.

    17. Force majeure

    YatruX is not responsible for service disruption due to events beyond our control: natural disasters, strikes, government action, internet outages, payment processor failures, or pandemic-related restrictions.

    18. Account termination

    You may close your account anytime from settings. We may suspend or terminate your account for violations of these terms, fraudulent behavior, or non-payment. Termination does not absolve outstanding obligations or pending payments.

    19. Modifications

    We may update these terms occasionally. Material changes will be communicated via email and in-app notice at least 7 days before taking effect. Continued use after changes take effect constitutes acceptance.

    20. Governing law & jurisdiction

    These terms are governed by the laws of the Federal Democratic Republic of Nepal. Any dispute not resolved through internal mediation falls under the exclusive jurisdiction of the courts of Kathmandu.
